Fair Use Policy - Updoc

Fair Use Policy

At Updoc, we are committed to providing accessible and convenient healthcare to our Users. The aim of this Fair Use Policy (Policy) is to ensure that the Services that Partner Practitioners provide on the Updoc Platform are used responsibly and fairly, while also preventing misuse or abuse of the Updoc Platform.

While we have used our best efforts to outline instances of Unacceptable Use (defined below), it is not possible to provide an exhaustive list of all instances of such use. From time to time, Updoc may form the opinion that certain use is Unacceptable Use and where we have done so, we will provide reasons for that opinion. Note that capitalised terms that are not defined in this Policy have the same meaning given in the Terms & Conditions.

What is Acceptable Use?

Before outlining matters that may be considered to be Unacceptable Use by Updoc, we have outlined some key criteria to determine when use is acceptable. Use will generally be acceptable when it is not deemed to be Unacceptable Use and includes where a User:

  • Provides timely, accurate, complete and truthful information
  • Uses the Updoc Platform to make legitimate health-related enquiries, consultations and outcomes
  • Respects the time and expertise of Partner Practitioners that provide Services through the Updoc Platform

What is Unacceptable Use?

Unacceptable Use includes doing or attempting to do the following:

  • Frequently cancelling requests without valid reasons
  • Manipulating or deceiving Partner Practitioners or Updoc staff
  • Providing false or misleading information during consultationSharing or requesting explicit or inappropriate content on the Updoc Platform
  • Submitting multiple requests for the same or similar issue, including after we have notified the User that a Partner Practitioner has deemed their issue or request to be ‘out of scope’
  • Enabling others to use your Account, requesting Services on behalf of another person or pretending to be another person (including by creating different accounts)
  • Submitting an unusually high number of consultation requests without medical necessity
  • Using the Updoc Platform for ‘drug-shopping’, ‘outcome shopping’ or similar conduct
  • Engaging in inappropriate or abusive behaviour towards Partner Practitioners or Updoc staff, including use of offensive or inappropriate language in any communications
  • Using the Updoc Platform to engage in or promote illegal or unlawful activities

Where Updoc or a Partner Practitioner reasonably believes that a User’s use of the Updoc Platform or the Services is Unacceptable Use, then Updoc may determine that there is a breach of this Policy.
